OVERVIEW

Welcome to Mycompanion. The terms “we”, “us” and “our” refer to My Companion Pet Food Ltd. We operate this website and store, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services.
These Terms of Service (the “Terms”) together with the policies referenced here describe your rights and responsibilities when using the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your jurisdiction and you consent to allow any minor dependents to use the Services on devices you own or manage.
You may be asked to provide information (e.g., email, billing, payment and shipping details). You warrant such information is accurate, current and complete, and that you have rights to provide it. You’re responsible for maintaining account security and all activity under your account. You may not transfer or license your account to others.

2. OUR PRODUCTS

We aim to describe products accurately, but colours/appearance can vary by device and settings. We do not warrant that any product will meet your expectations or match on-screen renderings.
Descriptions and pricing may change without notice. We may discontinue products or limit quantities per person, region or jurisdiction.

3. ORDERS

Your order is an offer to buy; we may accept or decline at our discretion. An order is accepted only once we confirm acceptance and process payment. Cancellations may be unavailable after acceptance. If we decline or cancel, we will try to notify you using the contact details you provided.
Purchases are subject to our Return & Refund Policy [LINK]. You warrant purchases are for personal/household use, not resale or export unless we agree in writing.

4. PRICES AND BILLING

Prices, promotions and discounts may change without notice. The price charged is the price at order time, shown in your confirmation, and excludes taxes, shipping, handling and any import charges unless stated.
Promotions may have separate terms; those govern in case of conflict for that promotion.
You agree to provide current, complete billing details and authorise us to charge for orders (including shipping, taxes/duties where applicable).

5. SHIPPING AND DELIVERY

Delivery times are estimates and not guaranteed. We’re not liable for delays caused by carriers, customs or events outside our control. Risk and title pass to you on transfer to the carrier.

6. INTELLECTUAL PROPERTY

All trademarks, brands, text, images, graphics, video, audio and their selection/arrangement on the Services are owned by us or our licensors and protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial use only. Except as permitted by law, you must not reproduce, distribute, modify, create derivative works of, publicly display or perform, republish, download, store or transmit any material from the Services without prior written consent. All rights not expressly granted are reserved.
“Mycompanion” and related names, logos and designs are our trademarks. Shopify’s names and logos are trademarks of Shopify. Other names/logos are the property of their owners.

7. OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Use is at your own risk and subject to the third party’s terms.

8. THIRD-PARTY LINKS

The Services may link to third-party websites or content. We are not responsible for examining or evaluating such content and are not liable for any harm arising from your use of third-party sites. Review their policies before engaging in any transaction.

9. RELATIONSHIP WITH SHOPIFY

Mycompanion is powered by Shopify. However, all sales are between you and My Companion Pet Food Ltd, not Shopify. You acknowledge Shopify is not responsible for the sales/transactions between you and us and you release Shopify from related claims.

10. PRIVACY

11. FEEDBACK

If you submit reviews, ideas or suggestions (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use and display such Feedback in any medium for any purpose. You warrant you have rights to the Feedback and that it complies with these Terms and applicable law. We may monitor, edit or remove Feedback at our discretion.

12. ERRORS AND OMISSIONS

From time to time there may be errors or omissions in product descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct or update and cancel orders where information is inaccurate, without prior notice.

You may use the Services only for lawful purposes and in accordance with these Terms. Prohibited uses include, without limitation: violating laws/rights of others; transmitting malicious code; scraping; sending spam; impersonation; interfering with security features; or conduct that, in our view, harms the Services, us, Shopify or other users. We may suspend or terminate access for violations.

We may terminate or suspend access to the Services at any time. You remain liable for amounts due up to termination. Sections intended to survive termination do so, including IP, Feedback, Disclaimers, Limitation of Liability, Indemnity, Severability, Governing Law and others by their nature.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, My Companion Pet Food Ltd and our directors, officers, employees, affiliates, agents, contractors, service providers and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of the Services or products, even if advised of the possibility. Nothing in these Terms limits liability that cannot legally be limited (e.g., fraud, death or personal injury caused by negligence).

You agree to indemnify and hold harmless My Companion Pet Food Ltd, Shopify and our respective affiliates, officers, directors, employees, agents, contractors, licensors and service providers from claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, violation of law or rights of a third party, or misuse of the Services.

18. SEVERABILITY

If any provision is unlawful, void or unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in full force.

19. WAIVER; ENTIRE AGREEMENT

No waiver of any term is a continuing waiver. These Terms and policies posted on the site constitute the entire agreement between you and us regarding the Services and supersede prior agreements.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms without notice.

21. GOVERNING LAW AND JURISDICTION

These Terms and any dispute or claim (including non-contractual disputes/claims) are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that consumers resident elsewhere in the U.K. may also bring claims in their local courts.
